  • Your baby had signs of low oxygen at birth, such as a low Apgar score or needing resuscitation for 10 minutes
  • Your baby shows moderate to severe brain effects from the low oxygen, as measured by a standard exam (Sarnat staging)
  • Your baby was born at 35 weeks or later in pregnancy
  • Your baby weighs 3.97 pounds (1800 grams) or more at birth
